Terms of sale

1. Who sells, and to whom

These terms of sale apply to every order placed in The Gear shop on antonybessala.com by a consumer, meaning a person buying for non-business purposes. The seller is {company_name}, {legal_form}, {address}, SIRET {siret}, VAT {vat}, email {email}, phone {phone} ("we"). By ordering you accept these terms, which are available on the Site at any time; please keep a copy.

2. Products

We sell clothing (hoodies, t-shirts, tank tops, caps) and sports accessories (gloves, resistance bands, lifting straps). Each product page describes the main features: material, fit, colours, sizes. Photographs and illustrations are indicative; colours may differ slightly depending on your screen. The size guide helps you choose. No product is personalised at the customer's request.

3. Prices

Prices are in euros, all taxes included (VAT included), delivery excluded. Delivery costs depend on the country you choose and are shown in the cart before any payment. No other costs are added; inside the European Union no customs duty is due. The price that applies is the one shown when you order.

4. Ordering

  1. You add products to the cart, choose the size and colour, then the delivery country.
  2. You can enter a discount code, check the contents, the total price and the delivery cost, and correct the cart.
  3. You tick the box accepting these terms and the privacy policy, then you are sent to Stripe's secure payment page where you enter your delivery address and payment details.
  4. By confirming the payment you place an order with an obligation to pay. The contract is formed when we send you the order confirmation email.

We may refuse or cancel an order in good faith if there is an existing dispute with the same customer, a suspicion of fraud, an obvious price error or a stock problem; you are then refunded in full.

5. Payment

Payment is due when you order, by bank card or by the methods shown on the Stripe payment page (for example Apple Pay or Google Pay). Payments are processed by Stripe, which encrypts your data; we never see your card number. Your order is prepared only after the payment is confirmed.

6. Delivery

We deliver to the European Union countries offered in the cart, to the address you give. Delivery times are estimates: clothing is made to order (production estimated at 2 to 5 working days, then transport estimated at 3 to 8 working days inside the EU); gloves, bands and straps ship from our own stock (estimated 2 to 6 working days). An order that mixes clothing and stocked accessories ships in two parcels, sometimes on different dates; delivery is charged once. Pre-order and limited items show their expected delivery window on the product page and in the cart.

If we do not deliver by the announced date, or at the latest within 30 days of the order when no date was announced, you may formally ask us to deliver within a reasonable extra period; if we still do not, you may cancel the contract and be refunded within 14 days. You may cancel immediately if the delivery date was an essential condition of your order (article L.216-2 of the French Consumer Code).

When the parcel arrives, please check it. Report any problem (damaged parcel, missing item) within 7 days to {email} with a photograph.

The risk of loss or damage passes to you when you, or a third party you named, take physical possession of the goods.

7. Right of withdrawal (14 days)

You have 14 days from receiving the goods to withdraw from the contract, without giving a reason and without penalty. If your order arrives in several parcels, the period runs from receipt of the last parcel. For a pre-order it runs from receipt of the product.

How to use it. Tell us your decision by a clear statement: write to {email} (quoting your order number) or use the model form below. You may also send the parcel back with a letter of withdrawal. You must send your message before the 14 days end.

Returning the goods. Send the goods back without undue delay and no later than 14 days after telling us you withdraw, to: {returns_address}. The goods must be unworn, unwashed, in their original state, with their labels. The cost of returning the goods is yours. You are liable only for a loss in value caused by handling beyond what is needed to establish the nature, features and working of the goods.

Refund. We refund every payment received, including the initial standard delivery cost, no later than 14 days after being told of your decision. We may hold the refund until we have received the goods or you have shown proof of dispatch. The refund goes back through the payment method used for the order, at no cost to you. If you return only part of a pack (for example the Day One Bundle), the pack price is recalculated on the items you keep, at list price.

Exceptions. Under article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. Our products are not personalised to the customer's name or choice: they are made to order from a standard design, so the right of withdrawal applies. If we ever offer personalisation, we will say so clearly before you order, together with the resulting exclusion of the right of withdrawal.

Champion Edition and numbered certificate. The numbered Champion Edition certificate is a digital document that goes with the hoodie; it is not sold separately. We assign the number, in order of payment: you do not choose it, so the hoodie is not personalised and you may withdraw. If you withdraw, the certificate and its number are cancelled.

8. Size exchange

Separately from the right of withdrawal, we offer the first size exchange of each order for unworn clothing in its original state, subject to the requested size being available: we pay the delivery of the new size. Write to {email} with your order number before sending the item back. This commercial offer does not replace the right of withdrawal above.

9. Legal guarantees

Whatever the right of withdrawal and the size exchange, we remain bound by the legal guarantee of conformity (articles L.217-3 and following of the French Consumer Code: you have 2 years from delivery to act, and a defect is presumed to have existed at delivery during that time; you choose between repair and replacement and, failing that, a price reduction or cancellation of the contract) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code: action within 2 years of discovering the defect). If a print is faulty or a product arrives damaged, write to us: we replace or refund.

Text of the legal guarantee of conformity: the seller delivers goods that conform to the contract and is liable for any lack of conformity existing at delivery. The seller is also liable for lack of conformity resulting from packaging, assembly instructions or installation when installation was the seller's responsibility under the contract. The consumer benefits from the legal guarantee of conformity for 2 years from delivery and can rely on it without having to prove that the defect existed at delivery during that time (articles L.217-3 to L.217-5 and L.217-7 of the French Consumer Code).

10. Limited editions and pre-orders

Limited-edition items (for example the Champion Edition, limited to 100 pieces) and pre-orders are marked as such, with the expected delivery window. Quantities are limited: if the last pieces sell while you are paying, we refund you in full. A pre-order is paid when you order.

11. Discount codes

The welcome code sent after you join the newsletter gives 10% off the items (not delivery), is single use and is valid for 60 days. Codes cannot be combined. If you return an item, we refund the amount actually paid.

12. Intellectual property

The marks, logos, visuals and texts of The Gear are protected (see the legal notice). Buying a product gives no right over them.

13. Product safety

Products placed on the market meet the applicable European product safety rules. The name and address of the manufacturer or of the importer established in the European Union appear on the page of each imported accessory (gloves, resistance bands, lifting straps): {importer_details}. Use sports accessories according to their instructions; they do not replace the advice of a healthcare professional.

14. Personal data

We process your data to carry out your order, as described in the privacy policy.

15. Customer service, mediation and governing law

For any question or complaint: {email}, {phone}. If our answer does not satisfy you, you may use the consumer mediator free of charge: {mediator}. These terms are governed by French law; as a consumer you keep the protection of the mandatory rules of the EU country where you live. You may bring a claim before the competent court under the ordinary rules.
